WHAT INFORMATION FOODSERVICE.COM COLLECTS FROM YOU WHEN YOU VISIT OUR SITE
One of the basic principles of Foodservice.com is that we ask only for the information we need to provide the service you have requested. In several areas of our site, we ask you to provide information by filling out and submitting an on-line form.

The features of the Web site where personal information is collected are explained below: Registering for Foodservice.com Membership: Registering with Foodservice.com is purely your own choice and is not a requirement for you to enjoy many of its features. When you register with Foodservice.com, you create a "User ID" of your choice and choose a secret password. We then ask for background information such as your name, current email address, street address with zip code, phone number, the nearest metropolitan region, and information on how you found us and your industry affiliation. In addition, we also collect industry demographic information (example: operator type, menu type, etc.) The more information you provide, the better we can customize your on-line experience. Once you register with Foodservice.com, you are no longer anonymous to us. You are asked to create a User ID and a password and are better able to take advantage of the many features of this Web site.

Social Media: In July 2009, Foodservice.com launched new social media tools. All registered users now receive a profile page by default. This page lists the user's name, profession, date joined, and the city associated with the zip code entered during registration. This information is listed on your profile page by default, but you have full control over what is displayed by logging in and accessing your site admin tools.

Registering for Forums and Chat Rooms: To post messages on Foodservice.com's forums and chat rooms ("Forums"), you must create a screen name and provide additional information relevant to the forums service. The information entered at this time is transferred to another server hosted by Food Service Enablers in Amherst, New York. Food Service Enablers hosts our forums service, so we transfer your UserID to them to create the linking records. Your information is stored and protected by Food Service Enablers. It is not used for any other purposes.

You also may provide us with your address, city, state, country, occupation, home page, interests, ICQ number, and personalized signature for forums postings. In posting messages, you are not required to post your real name; however, you are required to post your actual email address, although you may hide that email address from viewers. All of the information you provide, other than your password, will be viewable by other visitors of the Forums, as described in Section 2 below, so if you do not feel comfortable providing certain information, leave those fields blank during registration. In addition, your password is not encrypted and can be seen by the Forums' administrators, so do not use a password you would not like others to know.

Contact and Questions: You may submit questions, comments, or concerns to us on the Foodservice.com Web site. We will ask for your name, email address, your company name, and your comment or question. You may also provide your street address with zip code, phone number, fax number, and Web site.

Sweepstakes, Contests, and Special Offers: From time to time, we run sweepstakes, contests, and special offers, which you may choose to opt into. Participating in these promotions is purely voluntary. In these offers, we may ask participants for contact information (like your name, street address, email address), demographic information (like their zip code, age, occupation, or income level), and perhaps additional information.

Resumes: At the JobSpot at Foodservice.com, we give individuals the option of posting their resume in our database. We may ask you to provide contact information, including your name and email address, and to answer various questions about the positions sought, your education level, relocation preference, current job title, availability, current work status, title, a category for your resume to be listed in, and a brief overview of your resume. You will also be required to submit your resume if you are actively applying for a job within Foodservice.com.

Job Postings: At the JobSpot at Foodservice.com, we give companies the option of posting job openings in our database. We will ask you to provide your company name, a contact name, street address, phone number, email address, and credit card number if that is the selected method of payment. We will also ask you to describe the job you wish to fill.

Use of IP Addresses: An Internet Protocol ("IP") address is a number that is automatically assigned to your computer whenever you are surfing the Web. Web servers automatically identify your computer by its IP address. When visitors request pages from Foodservice.com, our servers log the visitors' IP addresses. We do not normally link IP addresses to anything personally identifiable, which means that a visitor's session will be logged, but the visitor remains anonymous to us. Foodservice.com collects IP addresses for the purposes of system administration and to audit the use of our site. We also use IP addresses to collect statistical information to send to our advertisers and for other marketing and promotional purposes.

Cookies: Foodservice.com uses "cookies" to collect non-personal information, as more fully describe in Section 5 below.

WHO IS COLLECTING YOUR INFORMATION AND WITH WHOM THEY CAN SHARE IT
Foodservice.com is committed to keeping your personal information confidential. We will not sell, trade, or rent your personally identifiable information to third parties. Individual Member Information: "Individual Member Information" is the information collected when you register. Individual Member Information will be used for research on usage patterns and product development, on-line site customization and targeted marketing. We will not give out to third parties your telephone number or email address. If you cancel your account, Foodservice.com will keep your Individual Member Information accessible to customer service for approximately six months after cancellation. Thereafter, it is placed in Foodservice.com's service bureau archives.

Information From Contact and Questions: The information you provide with your questions and comments will aid Foodservice.com in responding appropriately to your inquiries. We will use the information to respond to your inquiry and may share it internally to improve our service to you. In addition, we may use the information for various business purposes, including, but not limited to, sharing consumer testimonials about our products or services. These testimonials may be posted on the Foodservice.com Web site; however, we will not post them without your prior permission. In addition, we may share your testimonials with third parties; however, in such a case, we will not share your personally identifiable information, but we will just use your comment or question with your geographic location or other non-personal information.

Information From Surveys: Results from the surveys will be posted on the Foodservice.com Web site; however, personally identifiable information will not be posted. We may also use the information to conduct market research studies and reports. We use contact data from our surveys to send users information about our company and promotional material from some of our strategic business partners and to contact you directly. By participating in the surveys, you authorize us to send you additional direct marketing emails related to a specific product or service. However, you will be given a choice to "opt out" of being contacted in this way. (See Section 3 below).

Information From Contests, Sweepstakes, and Special Offers: We use contact data from our sweepstakes, contests, and special offers to contact winners. We also use this information to send users information about our company and promotional material and to give to advertisers, who may send you information about special offers on their products and services. However, you will be given a choice to "opt out" of being contacted in this way. (See Section 3 below).

Information From Resumes: Any visitor to the Web site may access your resume and view your personal information. Your resume may also display within your personal profile page within Foodservice.com. The ability to turn on and off the display of your resume is located within your admin section at www.foodservice.com/home/.

Information From Job Postings: Any visitor to the Web site may access your job postings. Visitors may see your company name and address, description of the job you wish to fill, and contact information to submit a resume and cover letter. If you do not wish for this information to be public, please do not place a job posting on the Foodservice.com Web site, or use alternative information in your job listing. If you choose to pay for the job posting with a credit card, we do not collect or store account information. All transactions are processed by PayPal.

Co-Branded Services: Some Foodservice.com services are offered in conjunction with a partner company. These are called co-branded services. In order to provide these co-branded services to you, it is necessary for us to share your personal information with our partners. If data is being collected and/or maintained by any company other than Foodservice.com, you will be notified prior to the time of the data collection or transfer. If you do not want your data to be shared, you can choose not to allow the transfer by not using that particular service.

Co-Sponsored Promotions: Promotions that run on Foodservice.com may be sponsored by companies other than Foodservice.com or may be co-sponsored by Foodservice.com and another company. Some or all data collected during such a promotion may be shared with the sponsor. If data will be shared, you will be notified prior to the time of data collection or transfer. You can decide not to participate in the promotion if you do not want your data to be shared. Currently, Foodservice.com promotions are limited to U.S. residents.

Foodservice.com Affiliates and Strategic Business Partners: We will share much of our data, including personally identifiable information about you as necessary, with our affiliates and strategic business partners that are committed to serving your needs throughout the world. To the extent that these entities are provided access to your information, we will use all commercially reasonable efforts to ensure that they will treat it at least as protectively as they treat information they obtain from their other users. We usually require our affiliates and strategic business partners to follow privacy practices no less protective of all users than our practices described in this policy. If you have any additional questions regarding the privacy practices of our affiliates or strategic business partners, please visit the privacy policies of their Web sites.

Aggregate Information: Foodservice.com shares the information you provided during registration, or during contests, sweepstakes, and special offers, in aggregate form, to serve ads and to provide on-line and off-line promotions. Foodservice.com also may share aggregate demographic information with purchasers of Foodservice.com microsites or similar service. When we say that we will share such information in "aggregate" form, we mean that we will not disclose individual names, addresses, telephone numbers, email addresses, or other personally identifiable information unless we have your permission.

Other Information Collectors: Except as otherwise expressly discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. To the extent that you disclose your information to other parties, such as outside links to other sites, different rules may apply to their use or disclosure of the personal information you disclose to them. To the extent that we feature third-party advertisements on our Web site, these advertisers adhere to their own privacy customs and policies. Since Foodservice.com does not control the privacy policies of third parties, you are subject to the privacy customs and policies of that third party. We encourage you to ask questions before you disclose your personal information to others.

However, Foodservice.com reserves the right at all times to monitor, review, retain, and/or disclose any information as necessary to satisfy any applicable law, regulation, legal process, or governmental request or to cooperate with law enforcement and other authorities in investigating a claim of illegal activity. Foodservice.com may use IP addresses to identify a user when we feel it is necessary to enforce compliance with our Terms of Service or to protect our service, site, customers, or others.

WHAT ARE COOKIES AND HOW FOODSERVICE.COM USES THEM What are cookies? Cookies are pieces of information that a Web site transfers to an individual's hard drive for record-keeping purposes. The cookie assigns you an ID, which allows Foodservice.com to recognize you when you return to the Foodservice.com Web site. This makes Web-surfing easier for you by saving your preferences while you are at our site. A cookie may save your Foodservice.com password while you are visiting the Foodservice.com Web site, so remember to log out when you are done visiting the Web site. Please see the security provisions in Section 6. The use of cookies is an industry standard--you will find them at most major Web sites. By showing how and when guests use a site, cookies help us see which areas are popular and which are not. Many improvements and updates to the site are based on such data as total number of visitors and pages viewed. This information is most easily tracked with cookies.

How does Foodservice.com use cookies? We use the information from cookies to provide services better tailored to our users' needs. For example, we use cookies to track user trends and patterns. This helps us better understand and improve areas of Foodservice.com that our users find valuable. While both of these activities depend on the use of a "cookie," visitors to Foodservice.com always have the option of disabling cookies via their browser preferences.

How can I disable cookies? Most browsers are initially set up to accept cookies. You can reset your browser to refuse all cookies or indicate when a cookie is being sent. However, note that some parts of Foodservice.com will not function properly or may be considerably slower if you refuse cookies. For example, without cookies, you will not be able to take full advantage of Foodservice.com's services, or you may have difficulty filling out surveys.

Advertisers: You may occasionally get cookies from our advertisers. Foodservice.com does not control these cookies. The use of advertising cookies sent by third-party servers is standard in the Internet industry.

WHAT KIND OF SECURITY IS IN PLACE TO PROTECT YOUR PERSONAL INFORMATION Passwords: If you register, your personal information is password-protected. However, you are responsible for maintaining the confidentiality of your password. Therefore, we recommend that you do not divulge your password to anyone. Foodservice.com will never ask you for your password in an unsolicited phone call or in an unsolicited email. If you have logged into the Foodservice.com Web site, remember to always log out when you have finished using our site. This will ensure that any passwords that might have been saved in cookies will no longer be saved. Also remember to close your browser window when you have finished using the site. This is to ensure that others cannot access your personal information and correspondence if you share a computer with someone else or are using a computer in a public place like a library or Internet cafe. If you lose or forget your password, you can use the "lost password" option on the sign-in screen.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, Foodservice.com cannot ensure or warrant the security of any information you transmit to us or any information provided by our on-line products or services, and you do so at your own risk. Foodservice.com will not be liable for disclosures of your personal information due to errors in transmission or unauthorized acts of third parties. However, once we receive your transmission, we make our best effort to ensure its security on our systems.
